Our Commitment to Privacy
At Love, Linda, LLC dba Teambrown Apparel ("TBA"), we respect and protect the privacy of our customers and those who use our website. To accomplish this, we collect certain personally identifiable information ("PII") that permits us to customize and enhance your online shopping experience and to communicate with you about our products, services, promotions, and contests. This Privacy Policy provides details about how your PII is collected and used.
What This Policy Covers
This policy describes: the customer information we collect and why; how we use this information and when we share it with third parties; the choices you can make about how your personal information is collected, used, and shared; and the data security, accuracy, and access measures we have adopted to protect customer information under our control from loss, misuse, or alteration.
This policy applies solely to information collected by TBA's website. It does not apply to the practices of people that TBA does not employ or companies that TBA does not own or operate.
TBA's website may be linked to Internet sites operated by other companies. Although we choose our business partners carefully, TBA is not responsible for the privacy practices of websites operated by third parties that are linked to our site. Once you have left the TBA site via such a link, you should check the applicable privacy policy of the third-party site to determine how they will handle any PII they collect from you.
The Information We Collect
TBA collects certain PII when you register for our newsletter or online shopping, place an order, or request other services that require information, registration, or subscription. This information may include your name, mailing address, email address, phone number, credit card numbers, and personal interests. We also keep a record of your product interests and purchases online, and automatically receive and record information on our server logs from your browser (including your IP address, TBA cookie information, and the page you requested).
TBA may use cookies to relate your use of our website to PII you have submitted to us. By submitting your information to us, you expressly agree that we may coordinate personal and cookie or other clickstream information in this manner. You can program your computer to warn you each time a cookie is being sent or to refuse cookies completely. However, without cookies you may not have access to certain features on TBA's website.
How We Collect Information
We collect information you provide to us when you request or purchase products, services, or information from us, register with us, participate in a public forum or other activities on our site and/or applications.
We collect information through a variety of technologies, such as cookies, Flash cookies, pixels, tags, SDKs, application program interfaces, and web beacons, including when you visit our site and/or applications or use our applications on third-party sites or platforms using one or more devices, whether or not you are logged in or registered.
We collect information using analytics tools, including when you visit our sites and/or applications or use our applications on third-party sites or platforms.
We may acquire information from other trusted sources to update or supplement the information you provide or that we collect automatically. Such data may include your postal address or your geo-location.
How We Use Information
TBA uses customer information for three general purposes: to customize the advertising and content you see on our sites; to fulfill your requests for certain products and services; and to contact you about new products or services, special events, and promotions. We use IP addresses to analyze trends, administer the site, track user movement, and gather broad demographic information for aggregate use.
Data Retention
TBA will retain customer information in accordance with a customer's instructions and as required by applicable law. TBA may retain information pertaining to you for as long as necessary for the purposes described in this Privacy Policy. Order and transaction data is typically retained for seven (7) years to comply with tax and legal obligations. Marketing preferences and account data are retained until you request deletion or close your account.
To the extent TBA inadvertently collects any information from a child under the age of thirteen (13) (see "How We Protect Kids' Privacy" below), such information will be deleted promptly upon discovery.
How We Share Information
Except as described below, TBA will not sell, share, or rent your PII to any third party.
TBA may send PII about you to other companies or people when:
• we have your consent to share such information;
• we need to share such information to fulfill promotional obligations;
• we need to share such information with companies that work on behalf of TBA in order to provide a product or service you have requested;
• we respond to subpoenas, court orders, or legal process; or
• we find that your actions on our website violate the TBA Terms of Use or any of our usage guidelines for specific products or services.
TBA may also share aggregate demographic information with our business partners, advertisers, and other third parties. Such information does not identify any individual person.
Data Processors
We share your personal data with the following trusted third-party processors, each bound by data processing agreements and permitted to use your data only to provide services to us:
• Shopify Inc. — e-commerce platform, hosting, and payment processing infrastructure. See Shopify's Privacy Policy.
• Klaviyo — email and SMS marketing platform used to send promotional communications and manage subscriber preferences. See Klaviyo's Privacy Policy.
• Shopify Payments — primary payment processor for credit and debit card transactions.
• Shipping and fulfillment partners — to fulfill and deliver your orders.
If TBA adds additional payment processors or data processors, this section will be updated accordingly.
How You Can Access, Change, or Delete Your Information and Preferences
You may, at any time, access and verify, correct, update, or remove your PII and preferences online at teambrownapparel.com and/or by contacting our Customer Support Team by email at privacy@teambrownapparel.com. If you prefer not to receive marketing communications from us, please let us know by sending us an email. Please note that it may take up to two weeks for your request to become effective. Thereafter, when you make purchases, we may still send you an email confirmation and may need to contact you if we have questions regarding your order.
Your Data Protection Rights (GDPR)
If you are a resident of the European Economic Area (EEA) or United Kingdom, you have the following rights regarding your personal data:
• Right of Access — You may request a copy of the personal data we hold about you.
• Right to Rectification — You may request that we correct inaccurate or incomplete data.
• Right to Erasure (“Right to be Forgotten”) — You may request that we delete your personal data, subject to certain legal exceptions (e.g., where we are required to retain data by law).
• Right to Restriction of Processing — You may request that we limit how we use your data in certain circumstances.
• Right to Data Portability — You may request that we provide your personal data in a structured, commonly used, machine-readable format for transfer to another controller.
• Right to Object — You may object to processing based on legitimate interests or for direct marketing purposes at any time.
• Right to Withdraw Consent — Where processing is based on your consent, you may withdraw it at any time without affecting the lawfulness of processing carried out prior to withdrawal.
• Right Not to be Subject to Automated Decision-Making — You have the right not to be subject to decisions based solely on automated processing that produce legal or similarly significant effects.
To exercise any of these rights, please contact us at privacy@teambrownapparel.com. We will respond to your request within thirty (30) days. You also have the right to lodge a complaint with your local data protection supervisory authority (e.g., your national Data Protection Authority within the EU, or the ICO in the UK) if you believe we have not adequately responded to your request or have otherwise violated applicable data protection law.
Legal Bases for Processing (GDPR)
We process your personal data under the following legal bases:
• Contractual necessity — to fulfill orders, process payments, arrange shipping, and provide customer service.
• Legitimate interests — to improve our website and services, prevent fraud, analyze usage trends, and send relevant marketing communications (where you have not opted out).
• Consent — for email and SMS marketing via Klaviyo, and for non-essential cookies where required by applicable law.
• Legal obligation — to comply with applicable laws, including tax, accounting, and fraud prevention requirements.
International Data Transfers
Teambrown Apparel is based in the United States. The United States is not currently designated as providing an “adequate” level of data protection under the GDPR. If you are located in the EEA or UK, your personal data will be transferred to and processed in the United States. We rely on appropriate safeguards for such transfers, including Standard Contractual Clauses (SCCs) implemented by Shopify Inc. and Klaviyo, to ensure your data is protected in accordance with GDPR requirements. For more information, see Shopify’s Privacy Policy and Klaviyo’s Privacy Policy.
How We Protect Kids' Privacy
TBA is concerned about the safety and security of children when they use the Internet. In accordance with the Children's Online Privacy Protection Act of 1998 ("COPPA"), TBA does not have actual knowledge of collecting PII from any child under the age of thirteen (13) without prior verifiable parental consent, and will not knowingly do so. If we discover that we have inadvertently collected such information, we will delete it promptly.
About "Cookies"
A "cookie" is a piece of data stored on the user's hard drive containing information about the user. Cookies permit us to track and target the interests of our users in order to enhance their experience on our website. TBA never saves passwords or credit card information in cookies. Advertisers or other companies do not have access to TBA's cookies. TBA may allow business partners presenting advertisements on some of our pages to set and access their cookies on your computer; however, TBA has no access to or control over such cookies.
Data and Credit Card Security
TBA takes the security of your private information very seriously. If at any time you believe the security of your password or account information has been compromised, please notify TBA immediately and either change your member information online or contact the TBA Customer Service Team at the email address above. Should you discover an unauthorized use of your credit or debit card, you should notify your card provider immediately in accordance with the terms of your agreement with that company.
